Race Sim Terms

1. About these terms
- These terms apply to entry into a race simulation run by KVZ Performance Pty Ltd (ABN 75 697 828 176), trading as KVZ Performance, at Unit 53, 3 Jackman Street, Southport QLD 4215 and on the surrounding public paths and streets used for the run course.
- When you enter, you agree to these terms for yourself and, if you enter a doubles team, on behalf of your partner. Each athlete must still sign the waiver personally.
- A race simulation is an independent event run by KVZ. It is not an official HYROX race, it does not produce an official HYROX time, and a result here does not qualify you for anything.
2. Your entry
- An entry is one place on the start line. A doubles team is a single entry covering two athletes who run together and share the stations, and is paid for once.
- Places are limited and allocated in the order entries are paid for. Your place is only confirmed once payment succeeds.
- Prices are in Australian dollars and include GST. Payment is taken in full at the time of entry and is processed securely by Stripe.
- Member pricing is verified against your KVZ account at the time of entry. It cannot be applied afterwards.
- Where a KVZ membership or program includes entry to a race sim, that entry is subject to availability and must be claimed by the date entries close. It does not reserve a place until you claim it, and the number of included entries may be capped. An unclaimed included entry may be carried to a future sim, at our discretion.
3. Who can enter
- You must be at least 16 on the day of the event. Athletes aged 16 or 17 must have a parent or guardian give consent as part of the entry.
- You must be medically fit to take part in strenuous exercise. By entering you confirm that you are, and that you have told us about any medical condition, injury, allergy or medication we should know about.
- We may refuse or withdraw any entry, before or during the event, where we reasonably believe taking part is unsafe for you or for anyone else. Where we withdraw an entry on safety grounds before the event, we will refund it.
- Pro divisions. Entering a Pro division requires previous experience at those weights, declared as part of your entry. We may move an athlete out of a Pro division and into the matching Open division where they cannot demonstrate the experience they declared. If we do, and the Open division costs less, we refund the difference.
4. Changing, transferring or cancelling your entry
- More than 14 days before race day: cancel for a full refund.
- From 14 days out until entries close: no cash refund, but you may transfer your entry to another athlete at no charge, or take a credit toward our next race sim. Contact us and we will arrange it.
- After entries close: entries are non-refundable and non-transferable. Waves, race numbers and first-aid sheets are built from the entry list at that point and cannot be changed.
- You can change division up until entries close, subject to space in the division you want. If the new division costs more you pay the difference; if it costs less we do not refund the difference.
- Not turning up on the day is not a cancellation and is not refundable.
5. If we cancel, postpone or change the event
- Minimum entries. The event needs a minimum number of entries to go ahead. If we have not reached it by the date stated on the event page, we may cancel and every entrant receives a full refund.
- If we cancel or postpone for any other reason, including weather, heat, facility or safety issues, you choose between a full refund and a credit toward our next race sim.
- We may change the course, the schedule, the stations, the equipment or the format where we need to for safety or practical reasons. Changes of this kind are not grounds for a refund.
- Part of the course is outdoors. The event runs in ordinary wet weather.
6. The schedule and your wave
- Any schedule published before the event is provisional. Waves are seeded on your estimated finish time and confirmed after entries close, and we will send you your wave time before race day.
- You must check in by the time we tell you. If you miss your wave we will do our best to fit you into a later one, but we cannot guarantee it and a missed wave is not refundable.
- Course cut-off. The course closes at the time published for the event. Athletes still out on course at that point are recorded as course closed, which is recorded separately from a did-not-finish. There is no refund for a course-closed result.
- Seeding. Start waves are allocated on your declared estimated finish time. We may reseed any entry at our discretion.
- Shared equipment and hold time. Stations are shared and short waits are possible at peak times. Any wait over 60 seconds caused by equipment availability is recorded by the station judge and deducted from your official time. Your result reflects your racing, not your queueing.
7. Divisions, results and prizes
- Divisions may merge. A division with fewer than four entries will not be separately ranked and will be combined with another division for results. We will tell you before race day if this affects you.
- Results are provisional until we publish them as final. We may correct a time, a placing or a status where there has been a timing, judging or data-entry error.
- Athletes who use a treadmill instead of the outdoor run course are listed in their own section and are not ranked against athletes who ran the course.
- Judges' decisions on standards and penalties are final on the day.
- Prizes are not guaranteed. Where sponsors provide prizes we will say so before the event; entry fees do not include or entitle you to any prize.
- Your result may be published on a public results page and shown on screens at the venue, with your first name, last name, division and time.
8. Safety, risk and the waiver
- Every athlete must read and sign the KVZ waiver as part of entering. An entry is not complete until the waiver is signed, and we may refuse a start to anyone who has not signed one.
- This event involves heavy loads, high intensity and running on public footpaths and across driveways and roads. There is a real risk of injury. You take part at your own risk and should only attempt movements and loads you are trained for.
- Follow the directions of marshals, judges and staff at all times, particularly at road and driveway crossings. You remain responsible for your own safety on the run course and must obey road rules.
- A first aid officer is on site. By entering you consent to us arranging first aid or emergency medical treatment for you if we reasonably believe it is needed, and to us contacting your emergency contact.
- To the maximum extent permitted by law, KVZ is not liable for any injury, loss or damage arising from your participation. Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.
- Spectators attend free of charge and are welcome, and are responsible for themselves and for any children with them.
9. Photography and media
- The event is photographed and filmed. By entering you grant KVZ Performance Pty Ltd a perpetual, irrevocable, royalty-free, worldwide licence to capture, store, edit and publish photographs, video and audio of you taken at the event, and your name, race number, division and result, for any purpose connected with promoting KVZ Performance and its events. That includes our website and app, social media, paid advertising, print, press and partner or sponsor channels.
- You are not entitled to any payment, and you waive any right to inspect or approve the finished material or how it is used.
- This is a condition of entry, not an optional extra. If you would rather not appear in published material, tell us in writing before race day or at the check-in desk and we will do our best to keep you out of it, but we cannot promise to remove you from crowd or wide course footage.
- We cannot control photography by other athletes, spectators or media present at a public venue.
10. Your information
- We collect the details on the entry form to run the event safely: contact details, date of birth, emergency contact and any medical information you give us. Medical information is used only for safety, is shared only with our first aid officer and event staff, and never appears on a race number.
- Entering creates a KVZ account for you so your result is saved to your profile and you can see your history across future events. You will be sent a link to set a password. Having an account does not make you a gym member and does not cost anything.
- We will email you about your entry, the event and your result. That is part of running the event. Marketing email is separate, only goes to people who have ticked to receive it, and every one carries an unsubscribe link.
